Survivor is suing presidential hopeful Newt Gingrinch over his use of their 1982 classic, “Eye Of The Tiger”, without getting permission to do so.
If he had just used “Endless Love” he might not be in this mess.
The song was recorded by Survivor and was first released in 1982, however it’s biggest claim to fame is its appearance in Rocky III.
According to TMZ, Rude Music Inc, which is owned by the band, filed a lawsuit yesterday, January 20th, in Illinois. The lawsuit claims that Gingrich has used the song as his into music since 2009, despite never getting permission to do so.
The lawsuit is demanding that Newt stop using the song immediately and pay an unspecified amount in damages.
Rude Music Inc. is also suing the American Conservative Union, for using the song in promotional videos featuring Newt Gingrich.
A rep for Newt’s campaign has said, “It is my understanding the band wants $200,000 because someone played their song. That’s one expensive concert ticket.”
